1. These General Terms and Conditions apply to all services, courses, and workshops offered by The Path of Mindfulness (hereinafter: “Provider”), located in Waalre, registered with the Chamber of Commerce (Kamer van Koophandel) under number 98874918.

Article 1: Definitions

1. Participant: The individual who registers for or attends a course, workshop, or event provided by the Provider.

2. Agreement: The agreement between the Provider and the Participant regarding participation in a course or workshop.

3. Activity: Any mindfulness training, workshop, retreat, course, session, or related event offered by the Provider.

Article 2: Applicability

1. These terms and conditions apply to every offer made by the Provider and to every concluded agreement between the Provider and a Participant.

2. By registering for a course or workshop, the Participant explicitly agrees to these terms and conditions.

Article 3: Registration and Payment

1. Registration for a course or workshop is done via the website www.thepathofmindfulness.nl or through direct written communication.

2. The agreement is finalized once the Provider confirms the registration via email and, if applicable, the required payment has been received.

3. Payment must be made in full within the payment term specified on the invoice, or at the time of online registration via the provided payment methods (e.g., iDEAL, credit card).

4. If the Participant fails to pay on time, the Provider reserves the right to deny access to the course or workshop until payment is received.

Article 4: Cancellation and Rescheduling by Participant

1.  Private Individuals (B2C)

• • Within 14 days of registration: A legal cooling-off period of 14 days applies after registration, allowing a full refund provided the activity has not yet started.

  • More than 14 days before the start date: Cancellation after the initial 14-day cooling-off period will result in a full refund minus administration costs of €20.

  • Between 7 and 14 days before the start date: 50% of the total fee will be refunded.

  • Less than 7 days before the start date or no-show: No refund is possible.

1. Companies and Business Bookings (B2B)

2. • More than 14 days before the start date: Cancellation is permitted with a full refund minus administration costs of €35.

   • Between 7 and 14 days before the start date: 50% of the total fee will be refunded.

   • Less than 7 days before the start date or no-show: No refund is possible.

3. General Cancellation Terms

• • All cancellations must be submitted in writing via email to info@thepathofmindfulness.nl.

Article 5: Cancellation or Changes by Provider

1. The Provider reserves the right to cancel or reschedule a course or workshop in the event of insufficient registrations, illness of the trainer, or force majeure (overmacht).

2. In the event of cancellation by the Provider, registered participants will receive a full refund of the paid fees.

3. The Provider is not liable for any consequential loss or travel expenses incurred by the Participant due to a canceled or rescheduled session.

Article 6: Health and Liability

1. Mindfulness courses and workshops are supportive and educational, and are not a substitute for medical or psychological treatment.

2. Participants are responsible for their own physical and mental well-being during the sessions.

3. If the Participant has pre-existing physical or psychological conditions, they must inform the trainer prior to the start of the course.

4. The Provider is not liable for any direct or indirect damage, injury, or loss suffered by the Participant during or as a result of participation, except in cases of intent or gross negligence by the Provider.

Article 7: Intellectual Property

1. All materials provided during the course or workshop (such as handouts, audio recordings, manuals, and presentations) are the intellectual property of the Provider.

2. Participants are not permitted to copy, share, distribute, or use these materials for commercial purposes without prior written consent from the Provider.

Article 8: Privacy and Data Protection

1. The Provider processes personal data of Participants in accordance with the General Data Protection Regulation (GDPR / AVG). Personal data is used solely for administrative purposes related to the course and will not be shared with third parties without consent.

Article 9: Governing Law and Disputes

1. These terms and conditions and all agreements are governed exclusively by Dutch law.

2. Any disputes arising from or related to the agreement will be submitted to the competent court in the district where the Provider is located.
